Terms and Conditions of Use – Jobipo

These Terms and Conditions ("Terms") govern the access to and use of the website, mobile application, dashboards, communication tools, APIs and all related services operated under the brand name Jobipo (collectively, the "Platform").

The Platform is owned, controlled and operated by Adshrtech Media Private Limited ("Jobipo", "Company", "we", "us" or "our"), a company incorporated under the laws of India, having its registered office at Shop No. 17–18, Ganesh Nagar, Benar Road, Nadi Ka Phatak, Neendar, Jaipur – 302013, Rajasthan, India.

By accessing, browsing, registering on, or using the Platform or any services offered thereon ("Services"), you ("User", "you", or "your") agree to be bound by these Terms, the Privacy Policy, and any additional policies, guidelines or agreements issued by Jobipo from time to time.

1. Definitions

Unless otherwise stated, the following terms shall have the meanings assigned below:

1. "Account" means a registered user account created on the Platform.
2. "Applicable Laws" means all laws, statutes, rules, regulations, notifications, guidelines and governmental orders applicable in India, including the Information Technology Act, 2000 and the Digital Personal Data Protection Act, 2023.
3. "Employer" / "Recruiter" means any individual or entity using the Platform to post job opportunities or hire candidates.
4. "Affiliate" means any User participating in Jobipo's referral or affiliate programs.
5. "Third-Party Services" means services provided by third parties including payment gateways, cloud providers, communication platforms, analytics tools, and APIs.

2. Eligibility

By using the Platform, you represent and warrant that:

1. You are at least 18 (eighteen) years of age;
2. You are legally competent to enter into a binding contract under Applicable Laws;
3. You are not prohibited or restricted by any law from using the Platform;
4. All information provided by you is true, accurate, current, and complete; and
5. You are not impersonating any person or entity.

Jobipo reserves the right to suspend or terminate access to the Platform if it determines, in its sole discretion, that you do not meet the eligibility criteria or have provided false or misleading information.

3. Nature of Platform & Role of Jobipo

3.1 Jobipo is a technology-enabled facilitation platform that enables interactions between job seekers, employers, recruiters, and affiliates.

3.2 Jobipo does not act as an employment agency, placement agency, contractor, broker, or guarantor of employment or income.

3.3 Jobipo does not:

• Guarantee job interviews, selections, employment, income, or affiliate payouts;
• Control or influence hiring decisions, salary negotiations, or employment terms;
• Verify or endorse employer or user claims unless expressly stated.

3.4 All employment decisions, communications, engagements, and transactions are strictly between Users, and Jobipo shall not be a party to such arrangements.

4. Services

Jobipo may provide, inter alia:

• Job search and application services;
• Employer hiring dashboards;
• Affiliate and referral programs;
• Notifications and communications via electronic means;
• Paid plans, subscriptions, or add-on services.

Jobipo reserves the right to add, modify, suspend, or discontinue any Service, in whole or in part, at any time without prior notice.

5. User Account Responsibilities

5.1 You are responsible for maintaining the confidentiality of your Account credentials.

5.2 You shall be solely responsible for all activities conducted through your Account.

5.3 You agree to notify Jobipo immediately of any unauthorized access or suspected security breach.

Jobipo shall not be liable for any loss or damage arising from unauthorized use of your Account.

6. Communication Consent

By using the Platform, you expressly consent to receive communications from Jobipo and its service providers via SMS, email, WhatsApp, push notifications, and other electronic means, including transactional and service-related communications.

Such consent shall be valid notwithstanding registration under any "Do Not Disturb" registry, to the extent permitted under Applicable Laws.

7. User Content & Data Responsibility

7.1 You are solely responsible for all information, content, documents, and data uploaded or shared by you on the Platform.

7.2 Jobipo does not verify the accuracy, legality, or authenticity of user-generated content and shall not be liable for reliance placed on such content by any party.

7.3 Jobipo acts solely as an intermediary with respect to user-generated content.

8. Employer Obligations

Employers and recruiters represent and warrant that:

• Job postings are accurate and lawful;
• No fees shall be charged from job seekers;
• All hiring practices comply with Applicable Laws.

Jobipo shall not be liable for employer conduct, hiring outcomes, or disputes.

9. Affiliate Program

9.1 Participation in affiliate programs is subject to verification, campaign-specific terms, and compliance checks.

9.2 Jobipo reserves the right to withhold, cancel, or reverse payouts in case of suspected fraud, misuse, or violation of policies.

9.3 Jobipo's determination regarding lead validity and payouts shall be final and binding.

10. Payments & Taxation

10.1 All payments shall be made through authorized payment gateways or banking channels.

10.2 Users are responsible for providing accurate payment and tax details.

10.3 Jobipo shall not be liable for delays caused by banking failures, incorrect details, or regulatory requirements.

11. Intermediary Status

Jobipo acts as an intermediary under Section 79 of the Information Technology Act, 2000, and shall not be liable for third-party content, communications, or actions, except as required under Applicable Laws.

12. Prohibited Activities

Users shall not:

• Engage in fraud, impersonation, or misrepresentation;
• Upload unlawful, misleading, or harmful content;
• Scrape, reverse engineer, or misuse the Platform;
• Use the Platform for illegal recruitment, scams, or exploitation.

Violation may result in immediate suspension or termination and legal action.

13. Termination

Jobipo may suspend or terminate access to the Platform, with or without notice, for violation of these Terms or Applicable Laws.

Upon termination, access to Services may be revoked and data may be deleted, subject to legal requirements.

14. Intellectual Property

All intellectual property rights in the Platform, including software, trademarks, designs, content, and data structures, are owned by or licensed to Jobipo. Unauthorized use is strictly prohibited.

15. Disclaimer of Warranties

The Platform and Services are provided on an "AS IS" and "AS AVAILABLE" basis, without warranties of any kind, express or implied.

Jobipo does not warrant uninterrupted, error-free, secure, or accurate operation of the Platform.

16. Limitation of Liability

To the maximum extent permitted by Applicable Laws:

You agree to indemnify and hold harmless Jobipo, its directors, officers, employees, and affiliates from any claims, losses, damages, liabilities, penalties, or expenses arising from your use of the Platform or violation of these Terms or Applicable Laws.

18. Force Majeure

Jobipo shall not be liable for failure or delay caused by events beyond reasonable control, including acts of God, government actions, system failures, or third-party service disruptions.

19. Modifications

Jobipo reserves the right to modify these Terms at any time. Continued use of the Platform after such modifications constitutes acceptance of the revised Terms.

20. Governing Law & Jurisdiction

These Terms shall be governed by the laws of India. All disputes shall be subject to the exclusive jurisdiction of the courts at Jaipur, Rajasthan.
